Hello and welcome to Kijani! This app is made with love by the Justdiggit Foundation from the Netherlands (registered office is at Prins Hendrikkade 25, 1012 TM Amsterdam, registration number: 51457008). Kijani is here to give you tips and advice on making your land greener and your farming even better.

Saying “Yes” to Our Terms

When you create an account and/or use Kijani, it means you’re okay with the rules and promises in these Terms and Conditions and our Privacy Notice. If you don’t agree, then we’re sorry, but you’ll need to stop using the app. 

The Terms and Conditions constitute a legally binding agreement between you and the Justdiggit Foundation in respect of your use of the app.

When Things Change

We might have to change these Terms and Conditions sometimes. If we do, we’ll let you know in advance, unless otherwise required by law. If you keep using Kijani after we post the changes, that means you agree to and will be bound by the new rules. If you do not want to agree to these or any updated Terms of Use, you can delete your account.

Privacy and Data Protection

Your privacy is very important to us. Our app, Kijani, asks for some information from you to make the advice we give better and to make your experience feel just right for you. For example, we might ask where you farm, what kind of land you have, and the kinds of crops you grow. Remember, sharing this information with us is completely your choice, and we promise to always take good care of it. We will use this information only to help improve the advice we give you and will not sell it to anyone else. Our way of handling your information is based on strong rules from a law called the GDPR. Making Your Account

You can make your own Kijani account with a name you choose and maybe a picture too if you like. Just make sure you keep your account details safe and don’t let anyone else use them because you’re in charge of your account.

Usage and playing Nice

Feel free to use all the great stuff on Kijani and share it with others in accordance with these Terms and Conditions. Make sure to tell them where you got it from. Some things you find here might belong to other people and may be protected by intellectual property rights and other laws, so please respect their stuff too. You must not use any part of the content in our app for commercial purposes without obtaining a license to do so from us or our licensors.

Kijani is a friendly place, so there are some things* we just can’t allow. That means nothing mean, nothing that hurts others, and definitely nothing that’s not for everyone’s eyes, like adult stuff or hate. Let’s keep it clean and kind.

*these things include, as determined by Justdiggit in its sole discretion, that you may not:

i) remove any copyright, trademark or other proprietary notices from any portion of the services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the services except as expressly permitted by us; (iii) decompile, reverse engineer or disassemble the services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the services or unduly burdening or hindering the operation and/or functionality of any aspect of the services; (vi) do anything unlawful, misleading, or fraudulent or for an illegal or unauthorized purpose; (vii) violate (or help or encourage others to violate) these Terms and Conditions or our other policies; (viii) do anything that is in any way defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive; or (iv) attempt to gain unauthorized access to or impair any aspect of the services or its related systems or networks.

The Rights You Give Us

By using Kijani, you’re giving us the thumbs up to use your information you submitted to make the app even better. But don’t worry, we’ll always respect your privacy.

Who Owns What

Just so you know, all the things that make Kijani what it is, like the design, the words, and the way it works, are owned by us. And if we use something made by someone else, we have their okay for it.

Neither these Terms and Conditions, nor your use of Kijani, convey or grant to you any rights in or related to Kijani, except for the limited user right granted above.

When We Say Goodbye

If something goes really wrong and we have to stop you from using Kijani, we will. But we hope it never comes to that. And if you or we ever decide to part ways, some of these rules will still apply.

We have the right to disable any account, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms and Conditions or there is otherwise any risk of loss or damage to any person.

No Promises

We built Kijani to be as helpful as possible, but we can’t make promises that everything will always be perfect. We cannot guarantee that Kijani will always function without disruptions, delays, or imperfections. We offer the app ‘as is,’ which means we can’t be held responsible if something isn’t quite right or doesn’t work like you expected.

Not Our Fault

We’re here to give advice and help you learn, but we can’t take the blame if things don’t go as planned on your land. The law says we can’t be held responsible for things like lost profits or if you’re not happy with the app.

In other words, we do not accept responsibility for: (i) losses not caused by our breach of these Terms and Conditions or otherwise by our acts; (ii) losses which are not reasonably foreseeable by you and us at the time of entering into these Terms and Conditions; (iii) any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content posted by others that you may encounter on Kijani; and (iv) events beyond our reasonable control.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or a breach of your consumer rights.

Removing, disabling or terminating your account in case something happens

If something happens because you used Kijani in a way you weren’t supposed to (i.e. if you clearly, seriously or repeatedly violate these Terms and Conditions; if you repeatedly infringe other people’s intellectual property rights; or where we are required to do so by law), and we get in trouble for it, we can immediately: (i) remove any content or information you shared in Kijani; and/or (ii) refuse to provide or stop providing all or part of the service to you (including terminating or disabling your account).

Where the Rules Live

We follow the laws from the Netherlands, which is where we’re from. So if we ever have any disagreements (which we hope we won’t), we’ll use the Dutch laws and we’ll go to the court located in Amsterdam, the Netherlands, to settle them, unless stipulated otherwise by mandatory Dutch or international laws.

Our Complete Agreement

What we’ve laid out here are all the agreements and understandings between you and us regarding your use of Kijani. It’s the complete picture. If for some reason a part of these Terms and Conditions doesn’t apply or is found to be unenforceable, don’t worry, all the other parts still remain in effect.
